Terms & Conditions

If you continue to browse and use this website you are agreeing to comply with and be bound by the following terms and conditions of use. The content of the pages of this website is for your general information and use only. Marbia Studios reserve the right at our own discretion to change, modify add and remove sections of these Terms and Conditions at any time without notice.

This website contains material which is owned by or licensed to Marbia Studios. This material includes, but is not limited to, the design, layout, look, appearance and graphics. Reproduction is prohibited other than in accordance with the copyright notice, which forms part of these terms and conditions.

• “Marbia Studios” is Bianca Stanton trading as “Marbia Studios”
• The “Client” is you, the person requesting the services from “Marbia Studios”
• The “Project” refers to the service you are hiring “Marbia Studios” to complete.
• The “Work” refers to the completed illustration, design or photography.

Quotations

• All quotations are valid for 14 days only.
• All quotations exclude GST. I am not required to charge GST.
• All Prices are in Australian dollars.
• Quotations do not include additional requests, changes or alterations unless mentioned in the quote. All additional work outside of what is listed in the quote will be billed at $80 hour.
• Marbia Studios bills at $80 an hour with a minimum charge of $40 (half an hour) per project.

Payment

• A 50% non-refundable deposit is required to book your project prior to the commencement of any design and/or illustration work.
• Payment is to be made via direct deposit. PayPal is available for international Clients.
• All invoice terms are 10 days from the date of issue.
• Payment plans are available for projects over $1000.
• Final Artwork files will not be given until the work has been paid for in full.

Communication

• Marbia Studios runs as an online business almost all our communication is done through email. This allows us to keep a record of project requests, revisions and approvals. All requests are to be given in email prior to any changes to be made.
• Phone calls by appointment only. I’m happy to talk through ideas and project details when required. Please email me to make an appointment.

Copyright

General Copyright
• All images, illustrations, designs & content displayed on www.marbiastudios.com.au, Marbia Studios Instagram and Facebook accounts are subject to copyright. They cannot be copied or used in any way without written consent from Marbia Studios and the client concerned. Any use or copying of images, images, illustrations, designs & content without consent may result in legal action being taken.

Branding Packages &  Logo Design Copyright
• The client is granted full copyright and reproduction rights of their logo and branding once the project is completed & has been paid in full.
• Marbia Studios retains the rights to use completed projects for their own promotional & marketing purposes. Including but not limited to display on Marbia Studios website, social media, in print or any other online portfolio.
• All unused & rejected concepts, layouts and ideas remain the property of Marbia Studios.

Graphic Design Copyright
• Bianca Stanton trading as Marbia Studios owns and retains the design(s) created. This is in accordance with the Australian Copyright Act 1968 (Cth). In summary, copyright is granted to the creator of the work unless the copyright is handed over in writing or the creator is an employee of the business and the work is created during their employment. As I am an Independent designer & illustrator I retain the copyright of the work.

• You are granted an exclusive license to use the design(s) for your businesses purposes such as in print, on a website, in social media and other business uses.
• The design(s) may not be edited in any way. You cannot add filters, rearrange the layout, change the colour or adjust the design in any way. You may crop the design(s) to fit websites, printed material or other business needs. This is providing the integrity of the design remains.
• You agree not to sell the design(s) in any form. Unless previously agreed to in writing no design(s) may be sold. You will need to contact Bianca Stanton trading as Marbia Studios to obtain these rights.
• Marbia Studios Provides print ready .pdf files for print & digital .png .jpg and other standard files for web.
• Marbia Studios retains ownership of all source files, no source files will be given to clients. If the client requires the source files this will need to be negotiated and Marbia studios may provide them for a fee.
• Marbia Studios retains the rights to use completed projects for their own promotional & marketing purposes. Including but not limited to display on Marbia Studios website, social media, in print or any other online portfolio.

Illustration Copyright
• Bianca Stanton trading as Marbia Studios owns and retains the copyright of the illustration(s) created. This is in accordance with the Australian Copyright Act 1968 (Cth). In summary, copyright is granted to the creator of the work unless the copyright is handed over in writing or the creator is an employee of the business and the work is created during their employment. • You are granted a license to use the illustration(s) for your businesses purposes such as in print, on a website, in social media and other business uses. Including art prints, cards etc… given away for free.
• The illustration(s) may not be edited in any way other than cropping the image. You cannot add filters, rearrange the layout, change the colour or adjust the illustration in any way. You may crop the illustration(s) to fit websites, printed material or other business needs. This is providing the integrity of the illustration remains
• You agree not to sell the Illustration(s) in any form. This includes but is not limited to art prints, cards, or other products which depict/use the illustration(s). Unless previously agreed to in writing no illustration(s) may be sold. You will need to contact Bianca Stanton trading as Marbia Studios to obtain these rights.

Supplied images & photographs

• Supplied images will need to be large enough for print (300dpi).
• Marbia Studios will advise you if your photograph is not the correct size. Please do not attempt to make the image larger than it was originally. This may reduce the quality of the image. In the case of the image being too small, or poor quality Marbia Studios may choose to reject the image and request another.
• Where the client supplies a photograph taken by a professional photographer, written permission must be obtained from the photographer prior to supplying the photograph(s) to Marbia Studios.
• By supplying images & photographs to Marbia Studios the client agrees to hold harmless and to indemnify Marbia Studios, for all liability, damages, and expenses it may incur as a result of processing and printing photographs and reproductions, including any other person claiming an interest in the photos.
• Marbia Studios reserves the right to refuse to use images and cancel your project if we suspect the images may infringe on someone else’s copyright.
• Marbia Studios reserves the right to refuse to use images that are not of suitable quality or that are offensive in nature.
• Marbia Studios is not liable for any poor reproduction quality of supplied images.

Approvals & Revisions

• All revisions need to be given in writing (email) prior to any changes being made. Revisions will not be accepted over the phone.
• All projects need to be approved in writing (email) prior to the files being released to the client.
Content, Errors & Omissions

Content, Errors & Omissions

• It is the Client’s responsibility to provide Marbia Studios with everything needed to complete the project, including all copy, photos and other content as and when requested, and in the format that we ask for. Work will not commence until all requested deliverables are provided.
• It solely the Client’s responsibility to check proofs carefully for accuracy in all respects, ranging from spelling to punctuation to technical illustrations. Marbia Studios is not liable for any errors or omissions. Even if these errors were from Marbia Studios it is the client’s sole responsibility to proofread and check all the details of their project. If errors are found after the final approval is made, the cost of a reprint is the Client’s responsibility.

Colour Variations

• The colour on your screen may differ from printed colours. This is because of monitor’s display images in an RGB colour format where printers print in CMYK. This can also depend on the calibration of your monitor. Marbia Studios will not be held liable for colour variations.

Files & Printing.

• Print design Clients are given print-ready PDF files. Digital design Clients are given print-ready PDF files, .jpg & .png files. There may be other files types provided these exclude source files.
• Marbia Studios will set files up in accordance with your chosen printers specifications. In the event, no printer specifications are provided Marbia studios will allow the standard of 3mm bleed and crop marks for print files.
• Source files (.ai .psd .indd) are not included as standard files except in branding projects. These can be obtained for a fee.

Turnaround time

• Turnaround time can vary depending on the scope of the project and how quickly a client provides all the required items requested. As well as the availability & current workload of Marbia Studios.
• Although Marbia Studios makes every effort to meet clients deadlines all quoted turnaround times are estimates only. Marbia Studios will not be held liable for any costs resulting from late artwork.
• It is the client’s responsibility to provide feedback and revisions in a timely manner to keep the project deadline.
• If a client deliverable (such as feedback, approvals, payment, content, images or anything else required to complete the project) is late more than 10 business days the project will be considered “on hold”. Once the deliverable is received the project will be re-activated and rescheduled according to Marbia Studios current workload and availability. This could be a delay of 1-6+ weeks.

No Guarantees

• Marbia Studios makes no guarantees for the design & illustration work provided. There are so many factors & variables that make a work successful that Marbia Studios cannot guarantee the outcome of a project or service.

Cancellation

• The Client may choose to cancel this agreement for any reason. The client must give 7 days written notice to Marbia Studios If they wish to cancel. Any deposit given before cancellation will be non-refundable.
• Marbia Studios may choose to cancel this agreement at any time for any reason. In the event that Marbia Studios does cancel this agreement written notice will be given to the client and all files and completed work will be provided to the client.

Final Word

Booking, Deposit, payment and approval of your project work are all considered acknowledgement and acceptance of these terms and conditions.

Marbia Studios may change this policy from time to time by updating this page. You should check this page from time to time to ensure that you are aware of any changes. This policy is effective from July 2018.
